Model Bill 01
Model Industrial Water Offset Act
Creates a state-administered, credit-based offset system for industrial water withdrawals, modeled on wetland mitigation banking. An Interagency Water Offset Review Board (IWORB) certifies offset projects and releases credits only after performance standards are actually met — not on a developer's projection.
Applies to facilities withdrawing over 50 million gallons/year, or any publicly traded company over 10 MGY
Mitigation sequencing required: avoid and minimize withdrawals before any offset credit can be purchased
Credits quantified under Volumetric Water Benefit Accounting (VWBA), a six-step, third-party-verifiable methodology
A public ledger tracks every credit from release through debit, so the same gallon can't be sold twice
Debit ratios scale with hydrological stress and timing — not a flat 1:1 trade
Annual compliance reports are posted publicly; a governor's drought declaration triggers automatic credit review
A lighter companion bill: mandatory annual water disclosure for large water users, so regulators and the public can check a "water-positive" or "water-neutral" claim against the same data set the Offset Act's registry produces — even in states that never adopt the credit system.
Same coverage threshold as the Offset Act: over 50 MGY, or any publicly traded company operating in the state
Requires watershed-level reporting (HydroBASINS Level 6 / HUC-8) of withdrawals, consumptive use, and discharges
An offset counts only if it's independently verified, hydrologically connected to the withdrawal, and department-approved
Reports and every offset disclosure are posted on the department's public website
Civil penalties up to $25,000 per violation per day for a false or missing filing
